Waiver
In consideration for my being allowed to volunteer at Florida Citrus Sports events and activities (an “FCS Sports Event”), I hereby agree as follows:
I (“Volunteer”), for myself and my estate, heirs, administrators, executors, and assigns, do hereby irrevocably and unconditionally agree to indemnify, release, hold harmless, insure, pay, defend, acquit and forever discharge Florida Citrus Sports Ventures, Inc., Florida Citrus Sports Association, Inc., Florida Citrus Sports Events, Inc., Tangerine Sports Association, Inc., and Florida Citrus Sports Foundation, Inc., and each of their respective officers, directors, employees, agents, representatives, contractors and volunteers (collectively, “FCSports”) from any and all liability and responsibility whatsoever, however caused, for any and all charges, complaints, claims, liabilities, obligations, promises, agreements, controversies, damages, actions, causes of actions, suits, rights, demands, costs, losses, debts, expenses, court costs, and attorney’s fees (for both trial and appellate levels), known or unknown that I, my estate, heirs, administrators, executors, or assigns may have for any loss, property damage, personal injury, death, accident or illness sustained or contracted by, arising out of, connected with or in any manner pertaining to FCSports or any FCSports Event, whether caused by the negligence of FCSports or otherwise.
I freely accept and assume all risks, dangers, and hazards that may arise from my participation in FCSports Events and that could result in loss, illness, personal injury, death, or property damage to me or to my property, whether caused by the negligence of FCSports or otherwise. I acknowledge that I am freely and voluntarily participating and that I am not required to participate in FCSports Events.
I further hereby agree to indemnify, defend and hold harmless FCSports from any judgment, settlement, loss, liability, damage, or costs, including court costs and attorney fees for both the trial and appellate levels, that FCSports may incur as a proximate result of any negligent or deliberate act or omission on my part during my participation in FCSports Events.
In signing this Waiver and Release, I acknowledge and represent that I have read and understand it; that I sign it voluntarily and for full and adequate consideration, fully intending to be bound by the same; and that I am at least eighteen (18) years of age and fully competent or that I am the parent or other legal guardian of the minor participant named above (minors must be age of 16 or older to volunteer for FCSports Events). I hereby agree that this Waiver and Release shall be construed exclusively in accordance with the laws of the State of Florida, without reference to or application of the conflict of law rules of Florida or any other jurisdiction.
I hereby give FCSports and its assignees the right to photograph, film, videotape, audio record, or record by any other means, my image, voice, or other likeness. FCSports shall have the continuing right to use any such photograph, film, videotape, audio recording, or other recording in the future without additional compensation to me, with or without identification of me by name.

I acknowledge I have read the FCS Volunteer Agreement and Code of Conduct (a copy of which is attached hereto) and agree that I am required to sign and comply with the FCS Volunteer Agreement and Code of Conduct prior to commencing any volunteer activities for FCSports.
